Court’s Wild Zoning Decision Blocks ‘Montana Miracle’

A Montana judge dealt a huge blow to zoning reform in that state by slapping down two laws that allowed duplexes and accessory dwelling units on residential land. NIMBYs had mobilized to push for the laws — which were called the ‘Montana Miracle’ — to be overturned. In other disheartening news, a judge in Minnesota struck down a law that eliminated single-family-only zoning (the nation’s first) and a Texas court squashed zoning reforms in Austin. Meanwhile, Charlottesville, Virginia, and Portland, Maine passed zoning reforms that beef up density and promote housing for the “missing middle.”
