Arizona Supreme Court: Surprise can build affordable housing complex
The Arizona Supreme Court ruled that affordable housing developer Dominium can build 601 apartments and townhomes for families and seniors in Surprise, prevailing over a protracted fight with NIMBYs who threatened to take the matter to a vote. The case hinged on a technical matter after residents gathered signatures following the city council’s 4-3 vote in 2022 to approve a change to allow a preliminary development plan. However, the change was administrative, not legislative, because it wasn’t a rezoning case. This meant it wasn’t subject to a referendum. A Dominium spokesperson said the company plans to close on the properties in the summer of 2024 and begin construction right away so the units are ready for occupancy by 2026.
